Excerpt from the rules of the "Community Fair Play" - Certified Investment Location Program

  1. Organisation and objective of the Program and certification The Program and certification are organised jointly by the Polish Chamber of Commerce (KIG) and the "Institute for Private Enterprise and Democracy" Foundation (Institute).
    1. The objectives of the Program and certification are:
      1. identification and promotion of investor-friendly communities,
      2. increasing the interest of investors and media in the community,
      3. creation of a positive image of effective local government administration,
      4. promotion of cooperation between the business and investor-friendly communities,
      5. improving investment service in communities by conducting procedure studies and investor assessments, and also by the development and implementation of plans of improvements facilitating investment processes in the community if this proves necessary,
      6. enhancement of individual promotion of communities, creating the models for effective investment promotion by communities,
      7. promotion of environment-friendly investments and of building of facilities adjusted to the needs of the disabled,
      8. assistance in exchange of information on effective investment promotion methods between communities,
      9. encouraging all communities in Poland to reliability and fairness in relationships with investors and entrepreneurs,
      10. implementation of high ethical standards of community employees, raising their professional qualifications and investor service skills,
      11. confirming the compliance with high standards in investment servicing and execution in the community.
    2. An investor-friendly community is a community which:
      1. undertakes active organisational, promotional, and financial measures aimed at attracting investors to the community,
      2. creates conditions conducive to the development of entrepreneurship and social activity in the community,
      3. is open to the outside,
      4. seeks to solve the emerging problems by mutual understandings,
      5. meets its liabilities,
      6. improves its infrastructure,
      7. promotes investments of pro-ecological nature and facilities adjusted to the needs of the disabled,
      8. is characterised by lawfulness and high ethical standards of the community employees.
    3. Program categories:
      1. The Program is conducted within the following five categories:
        • rural communities;
        • small towns; this category covers municipalities with up to 30,000 inhabitants,
        • medium towns; this category covers municipalities between 30,000 and 100,000 inhabitants,
        • cities: this category covers municipalities with more than 100 000 inhabitants,
        • tourism-oriented communities; this category covers communities where tourism plays an important role or which plan tourism development in the nearest future.
      2. Communities may compete for the title within one category only.
    4. Awards granted within the framework of the Program:
      1. the following awards are granted within the framework of the Program: the"Community Fair Play - Certified Investment Location" title, promotional emblem and certificate with the indication of the year of granting the title, the Program Laureate statuette for the best communities within individual categories, the honourable awards for communities outstanding within individual categories;
      2. the"Community Fair Play - Certified Investment Location" title, promotional emblem and certificate are awarded to the communities which have met the requirements of the Program and have obtained 72 of 100 possible points within the certification process;
      3. the Awarding Committee awards 1 to 3 Program Laureate statuettes to the best communities within each Program category;
      4. the Awarding Committee awards 1 to 3 honourable awards to the communities particularly outstanding within each Program category;
      5. the certificate confirms the fact that the promotional title and emblem have been granted. The community has the right to announce that it holds the certificate with the use of roadside billboards with the text"Certified Investment Location". The model billboards are available from the organisers. Roadside billboard placement should be approved by and consulted with the Program authorities;
      6. individual honourable awards may be granted within the Program for local government employees and local government authority representative for particular achievements in cooperation with entrepreneurs and investors;
      7. the communities which are awarded the certificate of the"Fair Play Community - Certified Investment Location" in three subsequent editions shall have the right to use the"Golden Business Location" title;
      8. the communities which are awarded the certificate of the"Fair Play Community - Certified Investment Location" in five subsequent editions shall receive the"Golden Statuette".

  2. Organisational units responsible for the Program and certification
    1. The Program activities are carried out by the following entities: the Awarding Committee, the Program Commission, and the Team of Auditors.
    2. The Awarding Committee assesses the course of the Program and makes the decision to grant the awards and honourable awards on motion of the Program Commission. The Awarding Committee is the highest authority of the "Community Fair Play - Certified Investment Location" Program. The Awarding Committee is composed of the following persons:
      1. representatives of entrepreneurs,
      2. representatives of the Marshal's Offices,
      3. representative of state administration,
      4. representative of the Polish Tourism Organisation.
    3. The Program Commission is appointed by the Institute for Private Enterprise and Democracy and consists of experts dealing with the issues of investment promotion in communities, business ethics, and entrepreneurship development. The Program Commission is responsible for:
      1. conduct of the Program and certification on the current basis,
      2. coordination of auditors' work,
      3. supervision of correctness of auditors' work,
      4. preparing proposals for the Awarding Committee concerning the granting of awards and honourable awards,
      5. granting Program certificates entitling to the use of the "Community Fair Play - Certified Location Investment" title and promotional emblem.
    4. The Program Commission appoints the Program auditors selected from persons who deal with investment promotion and entrepreneurship development and who know the specific character of local government administration. All the auditors form the Team of Auditors which is a collegial body.
    5. The auditors are responsible for assessing the written presentation of the community (made at least by 3 auditors), holding a certification audit in the community, preparing a report on certification audit, and making a decision by the Team of Auditors on certification recommendation for the community.

  3. Program access conditions
    1. Communities meeting the following requirements are eligible for participation in the Program:
      1. investment undertakings were executed in their territory in the year preceding the specific edition of the Program,
      2. they had the right to make administrative decisions concerning investments throughout the year 2006 (i.e. this right was not suspended during the calendar year),
      3. there was no compulsory administration established in the community in the years 2006 or 2007 due to the lack of lawfulness,
      4. they submit a written participation declaration within the deadline indicated by the organisers to the Program Office in Warsaw,
      5. they make payment for participation in stage I of the Program within 14 days of receiving the invoice "for participation in promotional Program - stage I" to the amounts indicated in the Polish version of the rules of the particular edition.
    2. The communities participating in the Program and certification for a subsequent time are granted 10% discount on payments made in stages I and II of the Program.

  4. IV. Program - stage I
    1. The Program participants who have met the requirements of item III.1 of these Rules will obtain from the Program Office questionnaire used for the preparation of the written presentation of the community. The communities participating in the Program and certification for a subsequent time prepare a simplified Program presentation.
    2. When accessing the Program, the participants agree for making accessible their telephone and address particulars and their own promotional materials to the Program "Community Fair Play" organisers, having at the same time the right to view and correct their own particulars held by the organisers.
    3. The Program participants undertake to send within the deadline specified by the organisers the completed questionnaire:
      1. original printed version, certified by bodies authorised to represent them, sent by a registered letter to the Program's office in Warsaw (ul. Trebacka 4, 00-074 Warszawa),
      2. electronic version, e-mailed to info@fairplay.pl, fund@post.pl.
    4. The Program Office verifies the correctness of documentation submitted by the participants in its formal aspects and asks for supplementation of the documentation if any deficiencies are discovered. The complete documentation together with the indispensable enclosures will be sent to the Program Commission.
    5. Within the deadline specified by the organisers, the Program Commission will qualify the communities to stage II of the Program on the basis of recommendations issued by the Team of Auditors. The condition for moving to stage II of the Program is obtaining at least 72 points. Each community may obtain 100 points at the most at evaluation of the materials sent within the framework of stage I.
    6. The Commission will evaluate:
      1. conditions of conducting economic activity in the community,
      2. organisation and quality of investor services in the community,
      3. access to physical infrastructure,
      4. quality and scope of business infrastructure,
      5. scope and quality of own investments of the community,
      6. scope and level of the investment offer of the community,
      7. pro-ecological character of investments in the community and their adjustment to the needs of the disabled,
      8. quality and scope of community promotion,
      9. the existing achievements in attracting business and housing investments,
      10. openness of the local community towards external investors.
    7. The Program Commission will advise forthwith the Program participants about the results of stage I by fax and will send a notification by post.
    8. All Program participants, until they obtain the certification decision of the Program Commission, may inform about their participation in the Program. The allowable form of information is "The community/municipality/city participates in the "Community Fair Play - Certified Investment Location" Program.

  5. Program - stage II
    1. Communities qualified to stage II of the Program pay stage II Program fee to the amount specified in the Polish version of the rules of the particular edition.
    2. During stage II, a certification audit and a random examination of the investors who have commenced or completed an investment process in the community will be conducted in the communities.
    3. The objective of the certification audit will be to confirm the particulars contained in the questionnaire and to obtain additional information evidencing the friendly attitude of the community and its reliability towards investors.
    4. During the certification audit, the auditor may ask for detailed data or for making additional data available to him, within the scope defined in the Program documents.
    5. At least 10 days before the audit, the auditor will draw up a list of persons whom he would like to meet, other than community employees. The list may include, for example, representatives of media suppliers, selected investors who have completed their investments, local business organisations, financial institutions, educational institutions, labour office, and other entities associated with investment execution or entrepreneurship. The community employees are asked to assist in organisation of a meeting with these persons, in accordance with the auditor' wishes.
    6. The studies on randomly selected investors will be conducted in cooperation with the community. Interviews with randomly selected investors will be held by organiser' representatives. The results of studies in the specific community will be available only to the given community and to the Program organisers. In particular, the community will be able to use these results for the improvement of investor service procedures and organisation.
    7. During stage II, the Program Commission will summarise the results obtained by the community in stages I and II and will undertake the decision concerning the granting of the "Community Fair Play - Certified Investment Location" title, promotional emblem, and certificate. A community participating in stage II of the Program, which within the framework of certification and studies obtains at least 72 out of 100 possible points, will obtain the "Community Fair Play - Certified Investment Location" title, promotional emblem and certificate. The Program Commission prepares also recommendations for the Awarding Committee, concerning the granting of awards and honourable awards within the framework of the Program.
    8. The Program results will be presented at a final gala with participation of the media, central government representatives, business organisations, members of parliament, embassies, potential investors, Program participants, and other invited guests.
    9. The Program laureates will be entered into the Internet database of investor-friendly communities. The Program organisers will inform regional authorities, media, and embassies about the awards and certificates obtained by the communities in the specific voivodship.
    10. The winners of the Programme shall have the right to use the promotional emblem and the "Community Fair Play - Certified Investment Location" title in their advertising, promotion and business correspondence for 1 year since the end of the relevant edition. Later, they can use it only with the indication of the year in which the title was awarded (e.g. "Community Fair Play 2007 - Certified Investment Location").

  6. Final provisions
    1. The decisions concerning the interpretation of Program records and requirements are made by the Program Commission which communicates them to the Team of Auditors.
    2. The Program Commission reserves the right to withdraw or suspend the right to the "Community Fair Play - Certified Investment Location" title if acts violating the Program objectives are discovered.
    3. The Program is serviced by "Przedsiebiorstwo Fair Play" Sp. z o.o. which is responsible for organisational work, recruitment of communities, collecting fees, and promotional activities for the participants.
